HolidayTravelWatch Provides Comment to EU Commission on the EU Package Travel Directive

The European Commission has called for stakeholders in the travel debate to make submissions on the future of the Package Travel Directive. HolidayTravelWatch has made its submission, highlighting 160 case study examples of travel problems experienced by travel consumers in the previous 14 weeks.  Many of these cases involve reports of holiday illness/sickness, changes to holidays, flight changes and poor customer service.

The travel consumer has reached a critical point in the operation of rights ‘enjoyed’ in their travel contracts. Many political, legal and travel industry commentators cite the fact that such rights are extensive and burdensome on the operation of a business.

In the UK the travel consumer principally ‘enjoys’ the protections of the Directive expressed through the PTR, 261/2004 The Flight Delay, Denied Boarding and Flight Cancellation Directive (261/2004). There are wider consumer law issues to which the Unfair Commercial Practices Directive (UCPD) seeks to resolve. In the debate of how the UK Consumer is suffering detriment, we consider that there is a need to primarily analyse the current state of legislative protection, and highlight how there is an urgent need to recognise the parlous state of that protection.
