UK tour operator fails to advise of major flight change causing the UK holidaymakers to miss their flight!

I have a complaint against a tour operator I used in the summer. Our return flight from our holiday left 4hrs earlier without my partner and I and nine other people. The tour opertor refuses liability stating that they have a booking regulation where if the flight change are 12 hrs or more they then have responsibility to tell their customes of the flight change. Is this an actual regulation? as I am wanting to take them to court for breach of contract. ABTA have offered no constructive advise.
