On 15/1/10 we booked a cruise from our local [NAME OF TOUR OPERATOR] shop. The cruise is on the [NAME OF SHIP] to embark on 12/2/10 from Tenerife for 7 days . We have since read numerous reviews on internet sites of a recent outbreak of the Norovirus on this boat and general bad feedback regarding leaks, santitation problems, stability issues and general disrepair on this ship. I understand that such reviews are subjective but there is a consistant trend in the reviews and some postings are from repeat clients who have sailed on the [NAME OF SHIP] and been previously happy. I have been back to [NAME OF TOUR OPERATOR] to express my concern as my husband is diabetic and we cannot risk unnecessary illness and are annoyed that while such things were happening we have been sold such a product. They spoke to their Head Office while we waited and we were advised that the ship was now being fumigated and that they are unaware of the other problems that many of the review sites are currently noting about the [NAME OF SHIP] general state of repair. We have agreed with [NAME OF TOUR OPERATOR] that we will monitor the situation until the week prior to our holiday but have asked about the chance of changing our holiday without loss of payment/incurring cancellation charges should continued bad reviews convince us of a health risk should we continue with the booking. They said that they might be able to argue the case but cannot promise anything. Therefore, could you advise where we stand legally as it seems to me that they’re in breach of the Sales of Goods & Services Act selling this product knowing the state of the [NAME OF SHIP]. Any advise would be gratefully received –
